Special Education

Experience Addressing Matters of Ohio Special Education Law

Legal assistance for the students most in need

As an attorney focused on Ohio education laws, Dan Margolis knows that special education students are often in dire need of a legal champion. Schools may be unwilling to deal with the expense and overhead of special needs students, and parents may be ill prepared to fight for the services to which special needs children are entitled.

Margolis & Atzberger, LLC is prepared to fight those battles. Dan Margolis knows how special education laws in Ohio can make a real difference for his clients, and he is willing to go the extra mile to provide the help they need.

Special education defined

As far as special education laws in Ohio — and across the country — are concerned, special education includes services and systems that ensure children with disabilities have maximum access to the standard education curriculum. Three federal laws in particular drive special education laws across the country:

  • Individuals with Disabilities Education Act (IDEA)
  • Section 504 of the Rehabilitation Act of 1973
  • Americans with Disabilities Act (ADA)

Individuals with Disabilities Education Act (IDEA)

Passed in 1975, IDEA guarantees that all public school students have the right to access the regular curriculum in the school they attend regardless of any disabilities they may have. IDEA guarantees children with disabilities a free appropriate public education (FAPE) in the least restrictive environment (LRE).

IDEA also lays out certain rules that ensure school districts pay for the needs of students with disabilities in their district.

Discrimination and special education students

Special education laws in Ohio and at the federal level prohibit discrimination against people with disabilities. Section 504 of the Rehabilitation Act prohibits programs receiving federal funding from discriminating against people with disabilities.

If you believe you or a loved one has been discriminated against in such a fashion, contact Cleveland, OH special education law attorney Dan Margolis today.
