Suspensions/Expulsions

School Suspension and Expulsion Laws in Ohio

Helping students and parents fight unfair scholastic punishment

Sometimes a school has no choice but to remove a problematic student for a certain length of time through either suspension or expulsion. These are extreme measures that no school should take lightly, and schools must follow certain procedures when pursuing a suspension or expulsion, some of which are defined by the state. It is possible to sue a school for wrongful action under school suspension laws in Ohio. If you are considering such an action, contact Margolis & Atzberger, LLC in Cleveland for guidance.

What is a suspension or expulsion?

Suspension involves temporarily removing a child from school for violating school policies or rules, usually for up to 10 days. Expulsion is a more permanent removal of the child for more serious violations. Some expulsions can be as long as one year, and some can be permanent.

Ohio law grants local boards of education certain leeway in making policies for suspension and expulsion, so make sure you understand the discipline code for your particular school. Generally, actions that warrant expulsion may include:

  • Committing an act that would be criminal if an adult committed it
  • Bringing a firearm or knife to school, school functions or extracurricular activities
  • Making a bomb threat to a school

Permanent expulsion is very rare, but it means you may never again attend a public school in Ohio. It is only possible if you are at least 16 and are convicted of a delinquent act.

If you are wrongfully expelled or suspended

If you believe you have been wrongfully expelled or suspended, you have the option of consulting with an attorney. A lawyer experienced in education law can review your case and determine if enough facts exist to prove the school erred in expelling or suspending you. If you choose to file a lawsuit against a school on the grounds of wrongful expulsion or suspension, you may have an attorney present at your hearing if you desire. Skilled and knowledgeable, Dan Margolis has more than 10 years of experience helping parents and students in Ohio with education-related legal matters.
